Are you driving a lemon? In the state of California, there are some pretty simple ways to find out. Has your car:
- Been in the shop more than twice for the same issue?
- Been in the shop for more than 30 days, cumulatively, for the same issue?
If you can answer yes to either of these questions and your vehicle is newer than three years old or has been driven for fewer than 18,000 miles, you may be entitled to a replacement or a repair.
Most Lemon Law cases involve vehicles that are still under the manufacturer’s warranty. In general, a new car warranty will cover the vehicle for 36,000 miles or three years, whichever comes first. Powertrain warranties may provide repair coverage for 60,000 miles or five years, whichever comes first. Some extended warranties will provide coverage for 50,000 and 1000,000 miles, respectively.
If your vehicle has a substantial defect that is covered by your warranty, you may be entitled to take action even if your car has more than 18,000 miles. This depends on the specifics of your warranty, when the problems first occurred, and when the vehicle was first taken in for repairs.
How a Lemon Law Lawyer can Help
The Lemon Law process can be incredibly confusing, is often quite long, and may involve unscrupulous businesses pressing advantage. It is always a good idea to have an attorney on your side who not only understands the law but is dedicated to helping you get the fair treatment you deserve – and in California, you are entitled to this service free of charge.
California Lemon Law requires that legal fees for Lemon Law attorneys be covered by the manufacturer. You have absolutely nothing to lose by calling an attorney to discuss your rights. You may, however, place yourself at a disadvantage if you choose to go it alone.
Remember, if your car qualifies as a lemon, you are entitled to a replacement vehicle or to a refund of the vehicle’s purchase price, less usage fees, without question. This does not mean that the process of getting a refund or replacement will be easy or straightforward. Having a Lemon Law attorney on your side helps smooth the process and works to ensure that your rights are protected and your best interests are served.
